Food trucks in Kansas
Kansas licenses food trucks at the state level through the Kansas Department of Agriculture. State law requires a food establishment license from the secretary of agriculture, issued after an inspection, and treats a mobile food establishment housed in a trailer as a food establishment with its own location. Cities such as Newton add their own vendor license and fire inspection on top of the state license.

The official pages checked do not state a statewide rule that every Kansas mobile unit must use a commissary. KDA's Mobile Food Establishment Facility Requirements handout lists a commissary with a written access agreement as one way to handle warewashing instead of an on-board 3-compartment sink, and says wastewater must be removed to an approved waste servicing area. Ask KDA Food Safety and Lodging what your unit needs before you apply. Source ↗
Kansas law makes it unlawful to sell tangible personal property at retail without a registration certificate from the director of taxation, and a separate certificate is issued for each place of business (K.S.A. 79-3608). Check with the Kansas Department of Revenue on how this applies to a mobile unit. Source ↗
The State Fire Marshal works with local fire departments, and their chiefs and authorized members may inspect for compliance. Newton, for example, inspects trucks before issuing a city license; its checklist limits LP to 200 lbs on manufactured trucks and 100 lbs otherwise, and checks for a Type I hood with suppression and at least one 2A-10BC extinguisher inspected and tagged each year. KDA's mobile handout adds that propane tanks, hoses, connections and fixtures must meet current safety standards. Source ↗

Questions and answers
Who licenses food trucks in Kansas?
The Kansas Department of Agriculture. Kansas law requires a food establishment license from the secretary of agriculture, issued after an inspection, KDA lists mobile food units among the food establishments it licenses, and Newton tells mobile vendors they need licenses from KDA and from the city.
Is a food trailer treated as its own food establishment in Kansas?
Yes. K.S.A. 65-656 says a mobile food establishment housed in a trailer is a food establishment with its own location. If it is not housed in a trailer, the equipment used to store, prepare or offer the food is treated as the food establishment.
Do Kansas cities require their own permits?
Some do. Newton requires a $50 annual city license and a fire inspection, Kansas City, Kansas requires an annual occupation tax license, and Olathe asks businesses collecting sales tax in the city to register their Kansas Retail Sales Tax Certificate number. Check with each city where you plan to sell.
Will a fire inspection from one city count in another?
Sometimes. As of 2025, Newton accepts valid proof of inspection from the Wichita, Sedgwick County and Mulvane fire departments. Ask each city's fire department before you set up.
