About these terms

These Terms of use ("terms") govern your access to and use of Food Trailers Marketplace (the "platform", "we", "us", "our"). By creating an account, posting a listing, or otherwise using the platform you agree to these terms. If you don't agree, please don't use the platform.

Who we are

Food Trailers Marketplace is a directory and matching surface for the Irish coffee, food trailer, and mobile catering trade. We connect suppliers with buyers, but we do not take part in any sale, hire, or service agreement between them. The service is operated from Ireland.

Eligibility & accounts

You must be at least 18 years old and have the legal capacity to enter into a binding contract. Supplier accounts must reflect a real business and use accurate company details — registered name, and CRO/VAT numbers where applicable.

You are responsible for keeping your password safe and for all activity carried out under your account. Notify us immediately if you suspect unauthorised access. We may suspend or remove accounts that breach these terms, applicable law, or that are inactive for an extended period.

Listings & content

You retain ownership of the listings, photos, descriptions, and other content ("your content") you post on the platform. By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content on the platform and in related marketing (search snippets, social previews, screenshots) for as long as the listing is live, plus a reasonable wind-down period after deletion or expiry.

You are responsible for the accuracy of every listing — title, description, photos, price, contact details, availability. Your content must not infringe trademarks, copyright, or any other party's rights, must not be unlawful, misleading, or harmful, and must accurately represent the product or service offered.

We reserve the right to edit, remove, or suspend any listing at our reasonable discretion if we believe it breaches these terms or the law.

Acceptable use

You agree not to:

• post fraudulent, misleading, or illegal listings
• impersonate another business, person, or our staff
• scrape, copy, or republish substantial portions of the platform without our written permission
• attempt to gain unauthorised access to any account, server, or data
• send unsolicited bulk messages or spam other users
• interfere with the platform's normal operation, security, or performance
• upload viruses, malware, or any code intended to damage or disrupt
• use the platform in any way that violates Irish, EU, or UK law

We may suspend or terminate accounts that breach these rules without prior notice where a serious or repeated breach has occurred.

Paid features

Most of the platform is free for both sides — listing, browsing, contacting suppliers. Two optional paid features are available to suppliers.

Verified badge subscription. Suppliers who want a manually reviewed trust mark can subscribe to the Verified tier (currently €10 per month or €100 per year, ~17% annual discount). Subscriptions auto-renew at the end of each billing period unless cancelled. The badge appears on listings and the public profile while the subscription is active. We may revoke verification at any time if a supplier no longer meets the criteria — for example, inaccurate CRO/VAT details, or a material breach of these terms.

Listing promotions. Suppliers can pay a one-off fee to promote a single listing in featured rows on the homepage, category pages, and search results (currently from €15 for 3 days to €80 for 30 days). Promotions expire automatically; there is no auto-renewal.

Pricing is shown in EUR and may change with reasonable notice. Existing active subscriptions and promotions are not affected by price changes during their current term.

Payments & refunds

Payments for paid features are processed by Stripe. We do not store full card details — Stripe handles them under their own terms. By making a payment you also agree to Stripe's terms of service.

Verified subscription cancellation & refunds. You can cancel anytime from your dashboard. If you cancel a monthly subscription, it remains active until the end of the current billing period. For an annual subscription, we refund pro-rata for the unused portion if you cancel within 14 days of the most recent renewal, or for the unused months if your account is closed at our request without breach on your part.

Promotion refunds. Listing promotions are non-refundable once active. If a technical fault on our side prevents a promoted listing from being shown for a substantial portion of its term, we will either extend the promotion or refund pro-rata at our reasonable discretion.

If you are a consumer (not acting in the course of a business), some statutory rights — including the EU 14-day cooling-off right where applicable — may apply that are not waived by these terms.

User transactions

Food Trailers Marketplace is not a party to any sale, hire, or service agreement between a supplier and a buyer. We do not handle payments for those transactions, do not hold deposits, and do not issue invoices on either party's behalf. Any contract, warranty, refund, delivery, or after-sales service is strictly between the supplier and the buyer.

We accept no liability for the quality, fitness for purpose, legality, safety, or accuracy of any product or service listed by a third-party supplier. You should carry out your own due diligence before agreeing to a transaction.

Reporting & moderation

If you spot a misleading listing, suspected fraud, copyright infringement, or other violation of these terms, please report it via the contact form. We aim to review reports within 24 working hours and may remove listings, suspend accounts, or take other action at our reasonable discretion.

We are not under a general obligation to monitor every listing proactively, but we do remove content we become aware of that breaches these terms or applicable law.

Privacy

Our handling of personal data is described in our Privacy policy. By using the platform you also agree to that policy.

Suspension & termination

You can close your account at any time by emailing us from your account email — we will delete your profile, listings, images, and personal data within 7 working days, subject to any legal retention obligations (for example, tax-related records of paid subscriptions).

We may suspend or terminate your account, with or without notice, if:

• you breach these terms or applicable law
• you use the platform fraudulently or in a way that harms other users
• you fail to pay for a paid feature after a reasonable grace period
• we are required to do so by law or court order

On termination, any active Verified subscription is cancelled and refunded pro-rata, and active listing promotions are removed and refunded pro-rata — unless the termination was due to your breach of these terms, in which case no refund is due.

Liability & indemnity

To the fullest extent permitted by law, the platform is provided "as is" with no warranties about its availability, accuracy, completeness, or fitness for any particular purpose.

We exclude liability for any indirect, consequential, special, or commercial loss — including lost profits, lost revenue, lost data, or lost goodwill — arising from your use of, or inability to use, the platform. Our total liability for direct loss is capped at the amount you paid us in the twelve months immediately before the event giving rise to the claim, or €100 if you paid us nothing.

You agree to indemnify and hold us harmless against any claims, losses, damages, or expenses (including reasonable legal fees) arising from listings or content you post that breach these terms or any third party's rights.

Nothing in these terms excludes or limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

Changes to these terms

We may update these terms from time to time. The "last updated" date at the top of this page reflects the most recent revision. For material changes affecting paid subscriptions, we will give at least 30 days' notice by email or in-account notification before they take effect; you can cancel during that period if you don't accept the new terms.

Governing law & jurisdiction

These terms are governed by the laws of Ireland. Any dispute is subject to the exclusive jurisdiction of the Irish courts.

If you are a consumer based in Northern Ireland, the United Kingdom, or another EU member state, this clause does not deprive you of any mandatory consumer protection rights you may have in your country of residence.
